Rhymesayers Privacy Policy

This privacy policy describes how Rhymesayers collects, uses, and shares data about you. It also describes your rights to control data about you. Legally speaking, Rhymesayers Entertainment LLC is the "controller" of this data.

The disclosures in this privacy policy cover store websites operated by or on behalf of Rhymesayers Entertainment LLC. We refer to all these together as our “Stores”. 

We sometimes operate stores on behalf of artists or other partners. In such cases the artist or partner may collect data from the Store directly and/or we may share data we collect via the Store. Either way the artist or partner will process data they collect or receive as an independent controller. We may operate as an independent controller for some purposes and a processor for other purposes. In all cases we operate as controller for payment processing, order fulfillment, and customer support purposes. Where possible we will post the artist or partner's privacy policy on the Store where data is collected. If you have any questions please contact us as described in the "How to contact us" section below.

Some third-party platforms or tools we use or link to from the Stores may also collect data for their own. purposes. In those cases, that platform's own privacy policy will apply to their independent collection and use of data. We do our best to partner with companies we trust to responsibly collect and use data about you, but please look at their privacy policies to understand how they will handle your data.

Our Stores are hosted by Shopify, who collects and processes personal information about your access to and use of the Stores in order to provide and improve the Stores for you. Information you submit to those stores will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Stores for you.

Analytics, cookies, and tracking

The Stores may use advertising technologies including cookies, tags, pixels, Local Stored Objects, or similar (“Cookies”). These technologies allow us to identify audiences of interested fans and target those fans with promotions and advertisements that we think may be of interest. 

Some of these advertisements may be personalized, meaning they are intended to be relevant based on your prior activity or demographic information we or the advertising partner has about you. The Digital Advertising Alliance operates a website at www.aboutads.info containing information about targeted advertising and how to opt out of targeted advertising by companies who participate in DAA self-regulatory programs.

We use analytics to better understand how our Stores are used. This includes Google Analytics by Google, who requires us to disclose how they process data collected through Google Analytics. Please see this link for information on Google’s processing of data.

Most modern browsers include Cookie controls, including whether to accept first- or third-party cookies and options to delete Cookies. US State Disclosures

We may require validation of your identity before fulfilling your privacy rights request. Validation will vary depending on the type of request and risk of disclosure to an unauthorized person. Validation steps may include providing a copy of a government-issued identification or similar, logging in with an account, or providing other details that support the authenticity of the request.

You may designate a third party as an agent to make privacy rights requests on your behalf. An agent must be designated in writing or through a power of attorney. We will require a designated agent to validate their authority prior to fulfilling requests made on your behalf.

If you are located in the European Economic Area or United Kingdom, you may have additional rights regarding our processing of personal data about you.

Information we collect and how we use it

We collect and use data about you as described here. Some data may be optional. The uses described here may be subject to your consent or other choices as required by privacy laws or other legal requirements.

Visit our Stores.  IP address or similar network information, browser information, device identifiers information, cookie or similar identifiers, location based on IP address, language and time zone settings, and page interactions (such as scrolling, clicks, length of visits, pages viewed). Understand traffic volume and use of our Stores, understand user demographics, identify and resolve technical issues, develop and personalize new features, generate audiences for online advertising, and measure the effectiveness of online advertising.
Make a merch, live experience, membership, VIP, or other product or subscription through a Store. Name, billing and shipping address, email address, phone number, and products ordered. Fulfill your purchase and provide customer support, manage past orders, recommend products you may like, personalize Store and marketing experiences, understand and predict sales including through machine learning models, analyze customer trends, research and develop new products, and maintain records of our fans.
Sign up for a mailing list. Email address, name, and in some cases city/country. We also collect engagement information such as how often emails are opened and links clicked from our emails.  Operate our mailing list, personalize messages we send, understand and improve the performance of our mailing list, create audience segments on social media or advertising platforms, and maintain records of our fans.
Sign up for an SMS list.  Phone number, name, country, messages you send, and in some cases your email or city. We also collect engagement information such as how often links are clicked. Log in to a Store. Name, email address, and other information about your account.  Protect your account, connect your activity on social media sites to our Store, allow you to manage your profile, track orders, or similar, provide a better account creation and login experience, and better understand our fans and their preferences.
Enter a drawing, sweepstakes, contest, giveaway, or user-generated content promotion. Name, email address, city/country, phone number, age, and any content or information you provide for the promotion. Winners may need to provide additional identifying information to ensure compliance with the promotion’s rules. Operate the promotion, including communicating with entrants and validating compliance with the rules of the promotion. For promotions with user-generated content, your entry may be displayed publicly or used in other ways consistent with the rules of that promotion.
Contact us with a question or customer service request. Name, email address, order information, and any information you provide about your question or concern. Respond to your questions or concerns, research and address product or service issues.

In addition to the above, we may use any data collected about you to manage your rights and choices, personalize Store experiences and messages, develop fan profiles, train machine learning or marketing optimization models, comply with legal or regulatory obligations, resolve disputes and enforce our agreements, secure our Stores, prevent fraud or other misuse, and protect the safety of our customers.

For individuals in the European Economic Area or United Kingdom, our legal bases of processing are:

  • Consent for direct marketing such as sending you emails and any online advertising or tracking where consent is required.
  • Necessary for performance of a contract for fulfilling merch purchases or other orders.

How we share information about you

We may share information about you in the following ways:

  • With vendors who provide services on our behalf. These vendors will only use data about you for the purpose of providing services and not for their own benefit.
  • Where consistent with applicable laws, business partners such as our record label, merch company, tour promoter, fan platform or community, social media platforms, or similar, including for for marketing or online advertising purposes.
  • With your consent or upon notice and opportunity to opt out, according to legal requirements.
  • In response to a legally enforceable subpoena, court order, government inquiry, or other binding legal process.
  • Where necessary to protect the rights, safety, or security of you or others.

We use some standard data practices that are considered a "sale" of personal information under certain laws including the. California Consumer Privacy Act. These include use of "custom audience" advertising features and standard online advertising tools on social media platforms such as TikTok, Meta, Google, and Snapchat.

We do not share mobile information collected through your SMS marketing opt-in with third parties or affiliates for marketing or promotional purposes. This information may be shared with subcontractors in support services, such as customer service. The categories of information sharing above exclude your SMS opt-in data and consent, which will not be shared with any third parties.

Your rights

You may have the right to control how we collect, use, or share information about you, including rights to access, correct, delete, obtain copies of, withdraw consent for, or opt out of our processing of data about you.

To exercise these rights, please contact us as described in the "How to contact us" section above. We will respond as quickly as we can within the time periods required by applicable laws, which in most cases is between 30 and 45 days.

Storage and retention of data

Our default rule is that we keep information about you as long as it is needed for the purpose it was collected or for a use disclosed above. We will use reasonable security measures to protect your data.

We may use service providers that store data in different parts of the world, including the United States. We take reasonable steps to ensure our service providers comply with international data transfer requirements, usually through approved data transfer agreements.

Children

Our Stores are not directed to children. If you believe we have collected data about your child, please contact us and we will either delete that data or obtain your parental consent for its use.
